Terms and Conditions of GalopWear.eu

1. Provider and Scope

These Terms and Conditions apply to all purchases made by customers via the online store operated by Galop Wear (hereinafter referred to as the „Seller”) at www.galopwear.eu.

These Terms govern the relationship between the Seller and the customer regarding the use of the website and the conditions of sale and purchase. By placing an order, the customer accepts these Terms and Conditions. Individual deviations or special agreements must be confirmed in writing by the Seller.

These Terms apply to both consumers and businesses, unless stated otherwise.

2. Conclusion of Contract

1. The product presentations in the online store do not constitute legally binding offers, but serve as invitations to place orders. Product images may slightly differ in color or detail from the actual products.
2. By submitting an order, the customer makes a binding offer to purchase. A contract is concluded when the Seller confirms the order via email. The confirmation email does not constitute acceptance but only acknowledges receipt. Acceptance occurs through a separate shipping confirmation or upon shipment of the goods.
3. If a product is unavailable, the customer will be informed immediately. In such cases, no contract will be concluded, and any payments already made will be refunded.
4. The Seller reserves the right to reject orders without providing reasons, especially in cases of suspected misuse or fraudulent activity.

3. Prices and Shipping Costs

1. All prices are in euros (EUR) and include VAT (where applicable). Additional costs, such as customs duties or handling fees for international deliveries, are not included and may be charged separately.
2. Standard shipping within Germany costs €5.99. Exact shipping costs are shown during checkout. For bulky or heavy items, additional charges may apply and will be communicated before order confirmation.
3. Any extra costs for cross-border deliveries (e.g. customs fees) are the customer’s responsibility. Shipping costs are always clearly displayed before the purchase is finalized.
4. The Seller reserves the right to change prices at any time. The price displayed at the time of order is the applicable price.

4. Payment Methods

1. Customers may pay using one of the available payment methods listed in the online store, including:
   • PayPal
   • Credit card (Visa, MasterCard)
   • Bank transfer (prepayment)
2. The Seller reserves the right to limit payment methods for certain orders. If payment by bank transfer is selected, the customer must complete the payment within 7 days of order confirmation. Otherwise, the order will be canceled.
3. Customers may only offset claims against the Seller if those claims are legally established or undisputed.

5. Delivery and Shipping

1. Deliveries are available within the EU. Delivery times may vary depending on the destination. The Seller will inform the customer of any significant delays.
2. The usual delivery time is 2–4 business days. If delays occur, the customer will be notified. If an item is not available or cannot be shipped on time, the customer may choose to wait or cancel the order.
3. The Seller is not liable for delays caused by force majeure or other unforeseen circumstances.

6. Right of Withdrawal

Withdrawal Policy

You have the right to withdraw from this contract within 30 days without giving any reason.

The withdrawal period expires 30 days after the day you (or a third party indicated by you) received the goods.

To exercise your right of withdrawal, you must inform us (Zargo Marek Czaja, contact@galopwear.eu) by means of a clear statement (e.g. by email) of your decision to withdraw from this contract.

Consequences of Withdrawal
If you withdraw from this contract, we will refund all payments received from you, including delivery charges (except for additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without delay and no later than 14 days after we receive your return.

Return shipping costs are the responsibility of the customer. The items must be returned in perfect, unused condition and in their original packaging. Refunds will only be issued if these conditions are met.

7. Warranty and Liability

1. The statutory warranty rights under EU consumer law apply.
2. The Seller is liable only for intent and gross negligence.
3. Transport damage is the responsibility of the shipping carrier. Visible damage should be reported immediately to the delivery provider.
4. The Seller is not liable for damage caused by improper use or normal wear and tear.

8. Data Protection

1. The processing of personal data is governed by the Privacy Policy available on our website.
2. Customer data is used solely to process orders and is not shared with third parties unless necessary for contract fulfillment.
3. No marketing-related data sharing occurs without express consent.
4. Customers have the right to request access, correction, or deletion of their personal data at any time.

9. Final Provisions

1. Polish law applies, unless otherwise required by consumer protection regulations in the customer’s country of residence. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
2. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the validity of the remaining provisions shall not be affected. In such cases, the parties shall aim to reach an amicable agreement.
3. The Seller reserves the right to amend these Terms and Conditions at any time without prior notice. The current version is always available on the website.
